Conducting a Sexual Harassment Investigation
A thorough sexual harassment investigation typically involves the following:
• Placing the alleged harasser on suspension immediately to prevent interference with the investigation OR changing the alleged harasser's work schedule to minimize interactions with the complaining employee, where possible
• Conducting a detailed interview of the victim of the alleged harassment and obtaining a written statement
• Conducting a detailed interview of the alleged harasser
• Conducting well-documented interviews of potential witnesses to the alleged sexually offensive conduct
• Conducting well-documented interviews of other employees who have worked with the alleged harasser
• Obtaining written and signed statements from each individual interviewed
• Informing each individual interviewed of a non-retaliation policy in connection with their participation in the investigation
• Assembling an investigation file which should include documentation of:
o Any disciplinary action taken;
o Interviews conducted;
o Written and signed statements of (1) the victim, (2) the alleged harasser, (3) witnesses, (4) other employees; and
o A detailed summary of the investigation conclusion and possible remedial action
• Notifying all parties involved of the status of the investigation upon its conclusion
